Please read and accept the terms and conditions of service below.       Terms and Conditions of Service The Applicant agrees to use TISCO E-Statement via the website of TISCO Bank Co., Ltd. (the “Bank”) pursuant to the details of service specified by the Bank as follow: 1. When the Applicant received the Reference ID from the Bank, the Applicant shall register and identify User Name and Password before start using TISCO E-Statement pursuant to the procedures and in the manner as stated on the website. 2. The Applicant shall keep User Name and Password confidential and not disclose to any other person. The Applicant shall also, at all time, solely use TISCO E-Statement by himself. 3. The Applicant agrees that all transactions which has been conducted, regardless of the type of account or whose service is, through TISCO E-Statement using the User Name and/or Password of the Applicant in accordance with the procedures or terms and conditions for the relevant type of TISCO E-Statement prescribed by the Bank shall be deemed valid, complete and binding on the Applicant without the need for the Applicant to affix his signature in any document or do any other act as an evidence therefor except for any request by the Bank or unless specified otherwise in this Application. The Applicant also agrees to be liable for all such transactions as if they had been conducted by the Applicant regardless of whether or not such acts or transactions had been done in bad faith by a third person. 4. In the case that the Applicant keys User Name and/or Password incorrectly for more than the number of times prescribed by the Bank, the use of TISCO E-Statement may be terminated by the Bank. If the Applicant wishes to further use TISCO E-Statement, the Applicant shall contact the Bank for re-apply. 5. The Applicant accepts that any application or performance via TISCO E-Statement in whatever means is reliable and enforceable among the Applicant, the Bank, and any related person. Furthermore, the Applicant represents that all records, evidences, document or any information produced by the Bank and/or the Applicant in connection therewith shall be deemed correct in all aspects without any requirement of the verification or signature of the Applicant. 6. In the case that the Applicant have to fill in an application or provide any information related to the services of the Bank or TISCO Group, the Applicant represents that all information provided is true and correct. In addition, if such application will be used for other services of the Bank or TISCO Group, the Applicant agrees and consents to comply with those terms and conditions. The Applicant also acknowledges that the notification or approval of the Bank is solely a primary notification or approval, it shall not be bound the Bank to provide any process until the notification or approval is confirmed in writing. The Bank reserves the right to request the Applicant to deliver any additional documents or evidences before providing a confirmation and/or alter or terminate the notification or approval if it has been found that any provided information or documents is untrue or incorrect. 7. Any document or notice sent to the Applicant to the address or e-mail as informed by the Applicant shall be deemed to have been duly acknowledged by the Applicant. 8. The Application acknowledges and consents the Bank to fix and charge any fee and/or service charge at the rate and in the manner as the Bank deems appropriate. The Bank reserves the right to change such rate and/or the manner to charge such fee and/or service charge at any time as the Bank deems appropriate. 9. The Application agrees and authorises the Bank to immediately debit, transfer or process any transactions on all type of the Applicant’s account opened with the Bank so as to the Bank is able to process or provide service requested by the Applicant and/or for paying any fee or service charge due to the use of TISCO E-Statement in accordance with the terms, conditions and procedures prescribed by the Bank. 10. The Applicant agrees and accepts that if the balance in the bank account, securities trading account or any type of the Applicant’s account is none, insufficient or exceeds the credit limit permitted by the Bank for proceeding with the Applicant’s request and/or the Bank has not received any required document for any type of services of TISCO E-Statement and/or the Applicant’s request is prohibited by law, rule or government’s regulation and/or the Bank has any necessity or obstruction whatsoever, the Bank shall have the right not to provide TISCO E-Statement at that time as the Bank deems appropriate and the Applicant agrees to waive its right to claim for any damages arising from such action of the Bank in all respects. 11. The Bank reserves the right to amend or supplement this terms and conditions and/or cancel the use of TISCO E-Statement of any or all Applicants at any time without having to give any reason. The Bank shall informed the Applicant not less than 30 (thirty) days in advance before exercise such right by posting a notice at the office or branch and/or making an announcement on the Bank’s website and/or sending a notice to the Applicant and/or any other method as the Bank deems appropriate, unless there is a reasonable ground, the Bank may not comply with the condition and method above and such amendment or supplement shall become effective at such time as notified by the Bank to the Applicant. If the Applicant continues using TISCO E-Statement, it shall be deemed that the Applicant agrees to bound by the latest terms and conditions including the terms and conditions related to the fee and/or service charge as amended and the Applicant agrees to waive its right to claim for any compensation, damages, or remuneration of any kind arising from the exercising right of the Bank in all respects (as the case may be). 12. The Bank reserves the right to change any format, display, procedure, security, condition or any other details contained on the website without prior notice to the Applicant. 13. The Applicant agrees to comply with any rule, terms and conditions for the use of TISCO E-Statement including manual or any document related to TISCO E-Statement, whether being at the present or any time in the future, and they shall be deemed as an integral part of this terms and conditions. The Applicant also agrees to comply with the Bank’s rule, any related entity and/or the applicable law, and produce to the Bank any documents required by the governmental agency and/or the Bank. 14. The Applicant acknowledges and accepts all risks incurred from any transaction via internet system for any reason, including but not limited to lost of information during transmission, delay in or unable to transfer as well as the computer of the Bank, the electrical or communication system errors, resulting in inaccessible or failure to use TISCO E-Statement, and the Applicant agrees to not raise such event to assert any claim against the Bank. 15. In the case that the Bank has a reasonable ground or there is a requirement of law, announcement or regulation of the governmental agency to disclose any information of the Applicant, the Applicant consents the Bank to inquire or disclose, without asking the Applicant’s permission, any and all details in relation to the Applicant whether or not the Applicant still uses TISCO E-Statement. 16. The Applicant agrees and consents the Bank to disclose, receive or exchange information of the Applicant with TISCO Group in order to investigate and analyse data of the Applicant for the Bank and TISCO Group’s business, and/or to provide the financial benefit and investment opportunity or any other benefits of the Applicant, and/or as the Bank deems necessary and appropriate. The Applicant also consents any company holding the Applicant’s information related to any product of the Bank or TISCO Group to disclose such information to the Bank without prior notice to the Applicant. 17. The Applicant agrees that the Bank shall not be responsible for any damages incurred to the Applicant as a result of the use of TISCO E-Statement. 18. In the case that there is any damages incurred to the Bank as a result of the Applicant’s use of TISCO E-Statement, the Applicant hereby agrees to indemnify, without any conditions, for all such damages in full to the Bank. 19. All contents on the website such as trademark, service mark, format, text, photographs, videos, etc. are the copyright of the Bank and are protected under the Intellectual Property Law as well as shall not be copied, adapted, sold, published or any other act in the manner of exploitation for business interest or other illegal objective without written consent of the Bank. 20. All hyperlinks to third party’s website is provided for convenience of the Applicant only. The Bank has no involve in whatever manner with such website and the Bank shall have no responsibility for any content shown on such website or any damages as a result of visiting such website. The Applicant agrees that it is the risk of the Applicant to access third party’s website or such hyperlink. 21. Any software downloaded service is provided for convenience of the Applicant only. The Applicant accepts any risk incurred from downloading such software form the Bank’s website and agrees that the Bank has no liability for any loss or damages as a result of computer viruses, Trojan horses or any other causes with the computer of the Applicant. 22. The Applicant agrees that this terms and conditions shall be governed by the Laws of Thailand and any dispute incurred from this terms and conditions shall be submitted to the jurisdiction of Thai court. By clicking on 'Accept' below you are agreeing to the Terms and Conditions of Service above and both the Programe Policy and the Privacy Notice. Accept
